This privacy policy (“Privacy Policy”) governs the processing of your personal data as a part of your use of our Website and the accompanying services (the “Website”). This processing is performed by APS as data controller, with registered office at Advanced Power Solutions NV; Nieuwe Gentsesteenweg 21; 1702 Groot-Bijgaarden in Belgium ("we”, “our", "us"), Registered No. 0414.688.361 (company registration number), in accordance with the applicable legislation relating to the protection of personal data. 

Please note that we can use so-called “cookies” or similar technology as part of the Website and/or the Services. Cookies are small text files that are stored on the hard drive of a device and that contain certain information, which sometimes includes personal data. We reserve the right to change the Privacy Policy. Such changes will be communicated through the Website.

Which data and why? 

When you use the Website and/or Services, we process personal data relating to you. Your personal data will be processed for the following purposes (including the legal grounds): 

When you create an itson account on our websites, applications.

When you create an itson account on an itson website or application, we ask you to provide certain personal data, such as your first name, last name, email address and country of residence. The required specific information may vary on the Service you have chosen.

When you register a product or device with itson.

If you choose to register the relevant product or device with us in order to enable certain features or benefit from any extended warranty or promotion. In order to register your product or device we may collect personal data, such as your name, address, phone number, email address and information about the APS product or device you own, such as its serial numbers (or other product/device identifier) and the date of purchase.

When you communicate with itson.

When you contact us or interact with our customer support representatives via email, live chat, telephone or in person, we may collect personal data, such as your name, mailing address, phone number, email address and contact preferences; and we may also collect information about the itson products or devices you own, such as their serial numbers and date of purchase. We also may create logs/reports that are useful in diagnosing product, Service or application performance related issues, and capture information relating to the issue. We use this information to provide you with customer and product support.

Promotions, games, prize draws and competitions.

If you enter into sweepstakes, contests, online games, prize draws, competitions or online promotions, e.g. cash back ("Activities"), we may use the personal data you provide to administer the Activities which includes, your first name, last name, address, email address and country of residence.

Subscriptions and newsletters.

Where you subscribe to our promotional communications and newsletters we will collect personal data from you including your email address, first name and last name. We will only provide such subscription services to you in accordance with applicable laws and where you have expressly requested us to do so.

When you upload personal data to an itson website or online application.

In addition to the above, we may collect such other personal data that you provide by uploading content (e.g. videos or photos) onto our websites or online applications. In such cases, the following personal data may be collected in order to publish the content on our websites or online applications: your name, email address, invoicing details as proof of evidence (e.g. for some online promotions) and any personal data in the content that you choose to upload. Where we collect such content we will only do so in accordance with applicable laws and not use such personal data for any other purposes than the purposes explained in this Privacy Notice.
 

Information about your use of the Services

We may collect information about your use of our Services through software on your itson device/product and other means, or your use of our online applications. For example, we may collect:

  • Device/product information such as your hardware model, the MAC address of the device’s wireless network interface and the mobile phone number used by the device in case you contact APS mobile network information, your mobile operating system, the type of mobile browser you use, time zone setting, and other unique device identifiers, IP address, operating system details, and settings of the device you use to access the Services.
     
  • Log information - such as the time and duration of your use of the Service, search query terms you enter through the Services, and any information stored in cookies that we have set on your device (such as your pc, mobile phone or tablet) or our application.
     
  • Location information - such as your product or device’s GPS signal or information about nearby WiFi access points and cell towers that may be transmitted to us when you use certain Services. Some of our location-enabled Services require your Personal Information for the feature to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose at the time of data collection. You can withdraw your consent at any time by altering the settings in your device/product.
     
  • Voice information - such as recordings of your voice that we make and may store on our servers when you use voice commands.
     
  • Other information - about your use of the Services, such as the online applications you use, the websites you visit, and how you interact with content offered through our Services.
     

Personal Information from third party sources

We may receive personal data from third parties (i.e. other companies) as follows:

  • Information from publicly available sources - we may receive or process personal data about you from publicly available sources, provided the receipt of such information is in accordance with applicable laws, which we may combine with other information we receive from or about you.
     
  • When you login to account with your social media credentials - e also may receive information about you from social networking sites when you choose to connect with those sites. Itson Account allows you to sign up and log in using your Facebook, YouTube (or other social network) account. If you do so, you allow Facebook (or other social network providers) to share certain personal data from your Facebook account with us. This personal data includes your name, general location, a link to your Facebook profile, your time zone, your profile picture, your "likes" and your list of "friends". This personal data is collected by Facebook, as controller, is provided to us and becomes subject to this Privacy Notice.
     
  • We recommend that you become familiar with Facebook functioning so as to know how you can control your Personal Data and its sharing by Facebook with us using any privacy setting in your Facebook account.

In principle, we obtain the above-mentioned personal data directly from you. However, if you choose to register through a social media account (for example Facebook, LinkedIn), this information is collected through your social media profile. We recommend that you consult the privacy policy of your social media service provider to determine which data is processed by your social media service provider when you use the social media login function.

We will not send any of the personal data you provide through the Website to social media providers unless you consent to this.

In addition to the above-mentioned objectives, we can also process your personal data:

  • to provide to a financial institution or payment service provider, to enable your financial institution and the payment service provider to fulfil his, her or its statutory obligations;  
  • to transmit to the police or the judicial authorities as proof of possible crimes or if there are founded suspicions of an unlawful deed or crime that you committed by means of your registration in or the use of the Website or the Services;
  • within the context of a possible merger with, acquisition of/by or demerger by a third party, even if such third party is outside the EEA.
     

With whom do we share data?

We do not send your personal data to third persons in a way that you can be identified without your express permission to do so if this is not necessary to provide the Services. 

We can rely on external processors to offer the Website and/or Services to you. We ensure that third-party processors may only process your personal data on our behalf and pursuant to our written instructions. We guarantee that all external processors are selected with the necessary care, so that we can rest assured of the security and integrity of your personal data. 

We can transmit anonymized data to other organizations that can use these data to improve products and services, and to organize bespoke marketing, presentation and the sale of products and services.
 

Where we process the data

We and our external processors will only process your identifiable personal data in the EEA.

We can transfer our anonymized and/or aggregated data to organizations outside the EEA. If such transfer is made, we shall ensure that there are appropriate guarantees to warrant the security and integrity of your personal data, and that all personal data rights that you might enjoy under applicable mandatory law are guaranteed.
 

How we process the data

We will do our utmost to process only the personal data necessary to achieve the objectives stated in this Privacy Policy. We will process your personal data lawfully, honestly and transparently. We will do our utmost to keep the personal data accurate and up to date.

Your personal data will only be processed as long as necessary to achieve the objectives stated in this Privacy Policy or until the moment at which you withdraw your processing permission. Remember that withdrawing the permission can imply that you will no longer be able to use all or part of the Website and/or Services. If you have registered on our Website, we will remove your personal data if you remove your profile, unless a statutory or regulatory obligation or a judicial or administrative order prevents us from doing so.

We will take appropriate technical and organizational measures to keep your personal data secure from unauthorized access or theft and from unintentional loss, manipulation or destruction. Our personnel or the personnel of our external controllers will only be able to gain access on a need-to-know basis and this is subject to strict obligations of confidentiality. However, you should understand that the care for security and protection consists only of an obligation of means according to best efforts, which can never be guaranteed. 

If and when your registration on the Website or use of the Website or Services can be regarded (a) as a breach of the terms and conditions of the intellectual property rights or any other right of a third party, (b) a threat to the security or integrity of the Services, (c) a danger to our or our subcontractors’ Website, Services or systems as a result of viruses, Trojan Horses, spyware, malware or any other form of malicious code, or (d) in any manner whatsoever illegal, unlawful, discriminatory or insulting, we may process your data in our own interests, in our partners’ or in third parties’ interests.
 

How long do you keep my data?

The retention periods vary depending on the nature of the service provided. We keep your data:

  • We will retain your personal data for the period necessary to fulfil the purposes for which your personal data has been collected as outlined in this Privacy Notice unless a longer retention period is required by law. When your personal data is no longer required for the purpose it was collected or as required by applicable law, it will be deleted and/or returned to you in accordance with applicable law.
     
  • In any case, as a general rule, we do not keep your data longer than necessary.
     

Your rights 

  • You have the right to request access to all the personal data that we process about you. However, requests for access that are clearly submitted with a view to causing us inconvenience or damage will not be dealt with.

  • You have the right to request that any personal data about you that is incorrect or inaccurate be corrected free of charge.

  • You have the right to withdraw previously granted permission for the processing of your personal data. You can withdraw your permission at all times by sending an email to info@ap.solutions

  • You have the right to request that personal data relating to you be removed if this is no longer needed in the light of the objectives that are outlined in this Privacy Policy or if you withdraw your processing permission. However, you must consider that a removal request to us will be assessed in the light of statutory or regulatory obligations or administrative or judicial orders, which may prevent us from removing the respective personal data. 

  • Instead of requesting removal, you can also request that we restrict the processing or your personal data if (a) you dispute the correctness of such data, (b) the processing is unlawful or (c) the data is no longer necessary for the objectives stated but you need it to defend yourself in judicial proceedings.

  • You have the right to object to the processing of personal data if you can show that there are serious and justified reasons regarding special circumstances warranting such an objection. However, if the envisaged processing is noted as direct marketing, you have the right to object to such processing free of charge and without giving any reason for this.

If your personal data is processed on the basis of permission or on the basis of a contract where the data is processed automatically, you have the right to receive the personal data provided to us in a structured manner and in a generally used format that can be read by a machine and, if technically possible, you have the right to directly transmit such data to another service provider. We will be the only persons to assess the technical viability of this.

If you wish to submit a request to exercise one or more of the above-mentioned rights, you can send an email to info@ap.solutions. Such request must clearly state what right you wish to exercise and why. We will notify you immediately when such request has been received. If it appears that the request is founded, we will grant the request as quickly as is reasonably possible and no later than thirty (30) days after the request has been received. Additional legitimation regarding your identity could be requested.
